Black Farmers Discrimination Litigation ~ Pigford II Information Meeting

by Michael Harris
The Port of Los Angeles is a fitting location for the first Pigford II meeting in California. During the 45th Anniversary of Kwanzaa, a sister port relationship with the Port of Los Angeles and Port of Durban, South Africa will help facilitate a new paradigm for Black Agriculture inclusive of Black Farmers in the Pan African Diaspora. The ongoing impact of past systemic racial discrimination throughout California, the #1 Agriculture State, remains an open secret while egregious civil rights violations remain unaddressed this 150 year anniversary of the USDA.

WHERE YOU CAN RECEIVE FREE LEGAL HELP IN FILING A PIGFORD II CLAIM

THE CLAIM FILING DEADLINE IS MAY 11, 2012

Black Farmers Discrimination Litigation Settlement,
(case number, 08-mc-0511 in the U.S. District Court for the District of Columbia),
also known as "the Black Farmers case" or Pigford II.

The Court in charge of this case ordered the website http://www.blackfarmerscase.com to provide basic background information about this case, and what rights you may have.

November 14, 2011 begins the claim period, Class Counsel will hold meetings in 21 states and Washington, D.C. The first month of meetings will focus on providing information about the case generally, in addition to assisting class members in completing their claim forms.

The meetings are intended to allow Class Counsel to provide information broadly across the country, including the large urban areas (such as Chicago, New York and Detroit) to which many individuals who farmed in the past, or who attempted to farm, migrated as a result of land loss in the South.

After the first month, Class Counsel will hold an additional 110 meetings, heavily concentrated in the Southeast until the Claims Deadline on May 11, 2012.

November 14, 2011 – May 11, 2012 - Claim Submission Period.

May 11, 2012 – CLAIM FORMS MUST BE POSTMARKED NO LATER THAN MAY 11, 2012.

Fall 2012 -Claim Adjudications- All claims submitted by Class Members before the end of the Claim Period will be decided by neutral third parties to determine if they are valid. This process is expected to take a number of months, and is estimated to be completed in Fall 2012.

Late 2012– Distribution of Awards – After all of the timely claims have been decided by the neutral third parties, and it is determined how much each successful claimant is entitled to receive, the Claims Administrator will distribute payments to successful claimants.

It is currently projected that the payments will be mailed at the end of 2012 but it is possible that the process may not be completed until Black History Month 2013.

While all claimants are permitted to submit a claim form without the signature of a lawyer, class members are reminded that they do not have to pay anyone to get a claim form or to complete a claim form.

Class Counsel will provide assistance to all confirmed class members without direct cost to the class member. Class members are strongly encouraged to attend a meeting in their area, and to call 1-877-810-8110 to be transferred to Class Counsel for an appointment, or visit this website for more specific location information.

This website is the best source for meeting information, as it will be updated frequently as the dates, times and locations are subject to change.

To request a Claim Form, you should call the Claims Administrator at 1-877-810-8110.
You can also request a Claim Form by writing the Claims Administrator at PO Box 4028, Portland, OR 97208-4028 or by sending an e-mail to Questions [at] BlackFarmerCase.com.

Note that the Claim Submission Period will begin on November 14, 2011 and end on May 11, 2012.
