The REAL Support KPFA

by Virginia Browning
http://www.supportkpfa.org
TOGETHER paid and unpaid staff and listeners prevented the selling off of Pacifica stations in 1999. Now IS the time to Support KPFA! Devastating as current layoffs of low-seniority staff are, former KPFA treasurer Brian Edwards-Tiekert knew this day had to come years ago.
Few would argue with the claim that current KPFA Morning Show hosts have done some excellent work seldom heard in radio these days. Alternative budgest? They have been scoured, hoping they could provide help.

In one article posted here by Carol Spooner, you can read laid off Morning Show host Brian Edwards-Tiekert urging OTHER Pacifica stations to make needed cuts, all the while supporting more hires by KPFA.

http://www.supportkpfa.org

Votes by Edwards-Tiekert and his allies on the National Pacifica boad during that time show his support for a regime at the New York station that was quickly draining the network. Mara Rivera and others have posted the details of this on indybay and elsewhere.

Locally, as treasurer of the KPFA Local Station Board, Edwards-Tiekert presented and urged, and with his majority on the board passed, budgets that hid important pieces of information from the board for several years in a row. This greatly exacerbated the current financial problems. (While the economy in general surely contributed, many on the board not of Edwards-Tiekert's group urged for years more caution and planning. Had their advice been heeded, KPFA would likely be spared this crisis now, even with the bad economy.)

Someone may post on indybay the section of the union contract (which I have seen) that forbids "job actions" when the contract is in compliance. It would seem that the constant on-air referral to a website giving much disinformation by Edwards-Tiekert and his on-air allies violates this contract.

For example: It is certainly disinformation, as is claimed on that site, that "people of color" were targeted for layoffs. It happens that 6 or 7 KPFA staff took VOLUNTARY leave.

At a meeting of the Berkeley Labor Commission Wednesday night, November 17th, a statement was made by Esther Manilla, one who took the voluntary leave, that she didn't think it would come down this way. She said, as I recall and others too, that she thought if she took leave some others from her show would automatically be spared.

However, the low seniority of Aimee Allison, for example, a very skilled host with a dynamic voice whom many, myself included, are sorry to see leave, has the lowest seniority of all on-air hosts.

One charge by Edwards-Tiekert is that the so-called "sustainable budget" -- rushed into the board meeting months and months after the budget should have been passed -- could have saved the layoffs. Despite its last-minute arrival, Pacifica Executive Director and CFO LaVarn Williams carefully checked and re-checked this budget, passing it by Pacifica's insurance company and others to ensure workability. However, as detailed by Engelhardt November 17th to the Berkeley Labor Commission and elsewhere, unfortunately this budget would not save the network and station from the need for cuts. That Engelhardt and Williams did carefully consider this alternative budget is never reported by Edwards-Tiekert's longtime gatekeeper group on the air or on their websites. Of course many of the famous guests who only know these gatekeepers as skilled trusted on-air personalities have now passed on the disinformation elsewhere.

One would think such actions WOULD be reason enough to at least sanction Edwards-Tiekert, but he has been supported by a local management at KPFA that aided in these damaging actions.

However, his layoff is NOT "payback" for even this, as he is now claiming, but the simple fact that within his job classification, he is one of the lowest in seniority. He is claiming that others there have lower seniority. Executive Director Arlene Engelhardt has emphasized that Edwards-Tiekert may well have "bumping rights" if he is qualified for other positions whose current job-holders have lower seniority than Edwards-Tiekert. Negotiation between union and management is set to be stepped up in the next few days.

The union emphasized to Executive Director Engelhardt that layoffs MUST follow union seniority guidelines. Engelhardt has emphasized that she stepped in months after local management neglected to stave off the crisis, carefully following this mandate from the union.

Does it take a rocket scientist to figure this out?

Thank you for the post. It's nice to see a sort of wave of people starting to realize the situation, due to the work of local activists who are documenting and writing it up.
This letter just in from Arlene Engelhardt, Pacifica Executive Director:

From: Arlene Engelhardt
Date: Thu, Nov 18, 2010 at 12:33 PM
Subject: RE: KPFA, thank you for your concern

Dear Friend of KPFA,

Thanks for writing to me with your concerns and support for KPFA. The station has fallen on hard times in recent years and had reached the point where layoffs were urgently necessary as KPFA could no longer meet its payroll.

KPFA regretfully is reducing its paid workforce from 44 to 35 full- and part-time employees, in order to balance income with expenditures for the fiscal year. During Fiscal Year 2009, the station spent almost $575,000 more than it took in. In the fiscal year that ended September 30, KPFA spent $480,000 more than it took in.

Seven employees volunteered to take a layoff package, but it was unfortunately necessary to lay off two employees, the hosts of the Morning Show. The involuntary layoffs were carried out under the seniority provisions of the labor-management contract Pacifica Foundation has with its union, the Communications Workers of America (CWA), with consideration given to crucial positions and special skills.

Reducing KPFA's workforce from approximately 29.75 full-time equivalents (FTEs) to approximately 25.3 FTEs will cut station personnel expenses by about $320,000 over the remainder of this fiscal year, resulting in a balanced budget.

KPFA will continue to offer a locally produced Morning Show, and its new line-up will be announced shortly. The Morning Show's focus on local community news and cultural affairs will continue.

Pacifica's policy is to negotiate employment disagreements amicably and as the law requires, in good faith. Pacifica hopes that KPFA can come together and focus on its mission to foster peace and social justice and to provide progressive news during these distressing political and economic times.

Thanks again,

Arlene Engelhardt

THE PACIFICA FINANCIAL CRISIS!
WHO IS RESPONSIBLE?

Former WBAI management did not pay their rent for four months and received a Three Day Notice to pay or be subject to eviction in March of 2009. This was not promptly communicated to the financial or executive management of Pacifica. WBAI has been losing hundreds of thousands of dollars a year for several years and currently owes Pacifica over $1,100,000.00 in back central services contributions. Each station contributes 20% of its listener-generated revenue to run the Foundation. When one station isn’t making its contribution the results are that the Foundation is short on money or the other stations have to pay more. This several year problem at WBAI and the current economic downturn has caused serious financial problems for Pacifica. The current Pacifica National Board (PNB), elected in January, gives hope for the survival of Pacifica.

Why didn’t Pacifica correct this problem early on? There was collusion among some PNB members from various stations to allow WBAI to do what they wanted to do with no oversight or accountability to the Bylaws or the listener/subscribers. The major players in this collusion were from KPFA, WBAI and WPFW, with a vote or two from KPFK and KPFT and the affiliate Reps on the PNB of past years.

The Local Station Board (LSB) majorities at KPFA and WBAI generally elected three PNB members that supported this collusion and WPFW, until recently, often sent four. There are 22 members of the PNB, four from each station and two Affiliate Representatives. An LSB majority can elect three of the four PNB members for their station. With ten votes from KPFA, WBAI and WPFW it only takes three votes from the ten from the other two stations and affiliate reps to have a majority to control the PNB and continue this collusion. Until this last January the Colluders had the majority for several years.

Who are the Colluders and why did they do this? Local tyrannical majorities wanted to run their stations without regard to the Bylaws and with no oversight from the Foundation. At KPFA the “KPFAForward” (2004) and “Concerned Listener” (CL) (2006 & 2007) slates represented the same management/staff faction and generally endorsed majorities that sent three PNB members who consistently voted to protect and continue the collusion. This group included William Walker, Sarv Randhawa, Rosalinda Palacios, Mary Berg, Sherry Gendelman, Bonnie Simmons and Andrea Turner. They consistently vote/voted with the Justice & Unity majority from WBAI and the WPFW majority. They generally sit together at the PNB meetings and are regularly seen privately caucusing together at lunch and before and after meetings, sometimes with GM Lemlem Rijio when in Berkeley.

Prior to this year’s PNB, Bob Lederer was the Justice & Unity leader on the PNB. I have attended many PNB meetings and listened to most of the others on line. During those meetings if KPFA Colluder PNB members were not sure how to vote they often passed if Bob Lederer hadn’t voted or passed. When he voted they would follow. If you don’t believe me go to the archives of the meetings and listen.
Whenever there was a move to correct the problems at WBAI the KPFA Colluders always voted with the others to protect the LSB majority at WBAI. Patty Heffley, the minority PNB Rep from WBAI, made a motion to have the PNB order the WBAI LSB to do a performance review of the general manager (GM) and the program director. The Bylaws require these to be done annually. At WBAI they had never been done, despite complaints from the LSB minority. The PNB Colluder majority refused to order the WBAI LSB to follow the Bylaws. Many others complained about WBAI being out of control and losing money and the Colluder PNB majority did NOTHING as the red ink continued to flow.

At KPFA the CL slate and the Rijio/Lilley management work together to make sure they maintain a majority on the LSB to elect three PNB members from their group. One of their methods was to have no election information on the air when the ballots went out and at the same time the CL sent a slate mailer. After the first time this happened I wrote a motion on the PNB Election Committee requiring election information to be on the air during the election. It passed out of the election committee by a 10-2 vote. The Colluder majority on the PNB voted it down. When KPFA finally ran some candidate information they ran 22 candidate statements in a row, always with Sherry Gendelman first! At the April 2009 PNB meeting in Berkeley the new non-Colluder PNB majority passed a motion requiring broad election coverage on the air. Bonnie Simmons, CL endorser, made a motion to rescind the required election coverage. It didn’t pass. And we will have a more inclusive election this year, no thanks to CL and its allies.

The Colluder majority was consistently against transparency. The Bylaws and California law allow Directors the “absolute right” to inspect all documents and facilities at any reasonable time. For years the Colluders fought to stop or hinder Directors’ Inspections. When inspections were finally allowed due to potential lawsuits it was discovered that $65,000 worth of equipment had been sent to a WBAI former GM’s father’s house and was not accounted for. As recently as 2008 a Director was ordered out of WBAI in the middle of a lawful inspection without any justification. Who gave the order? Dan Siegel, interim Executive Director, hired by the Colluder majority and a recent CL candidate.

So when you hear Brian Edwards-Tiekert, Sherry Gendelman, Bonnie Simmons, Conn or Matthew Hallinan, Warren Mar or any of the CL allies complain about KPFA money going to shore up WBAI, they and their allies are responsible for this crisis for trading fiscal responsibility for their power to ignore the Bylaws, transparency and accountability.

KPFA/Pacifica is a Commons that belongs to all of us, and it must be protected and preserved above the CL/Rijio group’s desire for unrestrained and unaccountable power.

KPFA is dead, get over it and move on. Create something that actually appeals to contemporary progressives.

The network should have died of natural causes long ago, and the kicking and screaming and trying to keep the rotted body alive long after it was a hopeless cause is not helping anyone.

Efforts, time, dedication, and money should be spent on building something that actually works, something that has not been corrupted to the point of Republicanism, something that actually meets progressive agendas.

It is counter-productive to keep playing pretend with KPFA. It's time to move on.

It's time for the programmers that clearly understand the mssion and who thus reject the self serving Bullshit from Brian Edwards-Tiergert , Philip Malderi, and others of that crew start clearly saying so: On the air on their programs !
Hard Knock Radio , Flashpoints , Guns and Butter, Voices from the Middle East and North Africa . and Across the Great Divide .
I know that you'll might have some concern re retailation but hey They already Hate you'll and would love to bump your shows off the air anyway and besides they would be on shakey ground since they have used their programs (Chris Welch's show, Against the Grain, and of course the News dept ) to spew disinformation and gross slanders like What's going on is '' Union Busting '' !
It's time to fight back on the air NOW !

Parts of this may appeal to some more than others, but do listen to the part 18 minutes in. That's when the whole rest of the world went silent for me. The beginning seems quite courageous under the circumstances as well.

Proper spelling in Brian's name is Tiekert...

"Proper spelling in Brian's name is Tiekert…"

According to a Youth Radio authority, the name is Brian Edwards Teacup. See him starring as Senator Joe McCarthy, with other insider demagogues, in "WORLD INTELLECTUAL WRESTLING: STAND DOWN DEMOCRATS vs STAND UP MEDIA ACTIVISTS"
http://www.youtube.com/watch?v=1A1aAXkwLsQ&feature=player_embedded

As much as the Teacup and Save K-Mart for Democrats want it to be all about him and them, the issue and struggle for Pacifica/KPFA isn't new, didn't start with them and kpfaworker.org, and it's about so much more than the Life of Brian and The Morning Show.

As Adrienne Lauby says in her fine, illuminating commentary on the Friday 11/19 Pushing Limits program http://kpfa.org/archive/id/65459, we didn't organize and protest in (before/after) 1999 to save the station and Pacifica network "…. so KPFA could have a couple of celebrity hosts bragging about how much money they raise …The protest we held against armed guards and 24/7 piped in music are cheapened when the same sidewalks are used to champion this overblown cause …"

"The majority of staff, paid and unpaid, at KPFA have no say in what is posted on that website you hear promoted so heavily (kpfaworker) … most of the staff want enough paid positions to keep … daily tasks in order … produce regular programs … We want stable management policies. We do not want the same programs and hosts on air for decade after decade. We want training and integration so young people, people of color, volunteers of all kinds can bring new ideas and produce world changing radio. We want 90% less fighting and 90% more collaboration…"

"Can something this positive happen? What creature of power and grace could rise from the ashes of this sad public spectacle? … We still have a chance, we can strengthen Pacifica and haul this station back on the road, and the next chapter is already being written."
