CALL TO ACTION AGAINST THE LBAM SPRAYING
Many thanks to all of you who have donated time, money and other efforts!

Many of you may have been present last Sunday when I asked a few people to join me in a federal lawsuit in attempt to stop the pesticide abuse and aerial spraying of pesticides.

While it was overwhelming on Sunday to figure out what to do and how many plaintiffs to add, I tried to focus on adding a few plaintiffs in hopes of bringing the enormity of the situation to the Federal
Judge on Monday. (NOW, I want YOU to JOIN if you like!...the more the merrier)

With several more co-plaintiffs, in addition to the first two, and many more folks in support at Monday's court appearance, the case was set for an evidentiary hearing on 11/21.

While it did not halt the spraying, it was basically the next best thing that we could hope for, i.e. the judge wanted to take an in-depth appraisal of the situation and granted us a full day hearing in
just about two weeks, which is an extremely quick hearing date.

THERE IS NOW A CHANGE OF THE COURT DATE TO TUESDAY 11/20 at 10 am

And rather than a full day evidentiary hearing, there is scheduled to be a short motion to dismiss, filed by defendants, rather than an evidentiary hearing. We intend to refute that and renew our request for a temporary restraining order, writ of mandate setting aside the fake emergency, and injunctive relief from this unjust experimentation with pesticides.

I think that there is even more reason to request immediate relief from the court especially in light of last night's aerial spray in Santa Cruz.

I, Marilyn Garrett and Aubrey Belgard intend to join Elsa Dooling, Janis Knepp and Jeff Haferman- the Vice Mayor of Monterey in alleging assault by the defendants.

I can taste and feel the effects of the pesticide and I have recently learned that the false moth emergency is being used to justify other pesticide abuses and this is intolerable.

At this point, I would like to sympathetically ask anyone who would like to join me and the other co-plaintiffs, who are all representing our own selves, to join in this federal lawsuit.

While last Sunday I was hesitant to add a whole lot of folks, now I think that, after the spraying, the key to success here includes MANY PEOPLE JOINING TOGETHER in this legal proceeding as natural persons, pro se.

The power of numbers as well as revealing the reality that the MOTH THREAT is a MYTH are the things that may help us get a Judge to order the pesticide warfare STOPPED!!!

So, I am inviting you to join me and Santa Cruz City Councilmember Tony Madrigal at the Santa Cruz City Hall on Monday November 12th from 10-3. Tony Madrigal has reserved the Council chambers and we can use the conference room.

I am hoping very much that Ed Porter and Daniel Feldman, who worked so tirelessly last Sunday, as well as others with laptops and writing expertise, will join us.

I will address folks at three different times: 10 am, 12 noon, and 2 pm.

I am preparing a sample affidavit, which you can customize.

Note that whereas last Sunday I really emphasized most folks participating by completing affidavits, I would like to focus on a new and vigorous effort to invite anyone to join as a co-plaintiff,
pro se.

This will entail a new, or updated, affidavit for Santa Cruz folks, as we will need to document the spraying and the effects.

The idea is to have it be an informative and work party, i.e. work on completing new affidavits – after the spray we have much more to say–and consider if you would like to also be a plaintiff, which
entails signing the complaint, i.e. the lawsuit.
