In a letter sent out to the Department of Labor Office of Labor Management Services (OLMS) Doug details the Loveall Leaderships many business ventures taken on while they are raking down big bucks to represent us.

We found it a bit strange that during the ’04 BAC contract campaign that Jacques was producing four films with his company Dream Reel films.

The letter to the DOL follows and it probably wouldn’t hurt if we followed up with copies on our own. There are over 100 pages of evidence that was turned in with the letter. We hope that an investigation is ongoing but we have heard anything yet.

Dear Mr. Heaney,

It has come to our understanding that the leadership of local 588 UFCW had or has been running a number of for profit businesses and one non-profit foundation under the shadow of their duties and with the possible intermingled use of expenses such as the use of the union jet, union cars, gas, phones and paid time.

It is our understanding that they are busy trying to bury these business dealings as the have become more widely known. There have been many rumors of “mob” connections within our union. Some of these dealings are very suspect.

· The current President Jacques Loveall owns a company called Dream Reel Films with 4 movies in development and production in 2004, according to his website.

· Jacques Loveall created and ran what appeared to be a for profit company call union online which was organized within the walls of the local union to put other unions in Northern California online.

This was extensively discussed within the walls of the union. This entity is a privately held company that has issued stock.

·A cashiered union business agent named Michael Troy Moore alleges that Jacques Loveall was (and may still be) renting units to some staff. He said that union leadership requires staff to use specific real estate agents and tax preparers to do their personal business. It appears that he has taken a payoff to keep his silence since he will no longer talk about these matters.

· Moore alleges that until recently the union paid for their tax returns being done for them by a tax preparer. We feel that this is the tip of the iceberg in illegal perks given to staff in order to control them.

· According to an extensive South Florida newspaper article Jacques Loveall, and a variety of union insiders created or attempted to create an investment vehicle called NATIVFUND in which they tried to personally participate in along with attempting to bring in the UFCW Northern California Pension fund.

· The union leadership runs a nonprofit foundation with excellent intentions but the donors are a veritable who’s who of industry insiders, companies represented by the UFCW, unions, pension contractors and others with deep UFCW union ties in the United States and to our pension fund.

· Federation of Agents & International Representatives is reportedly a union run out of the offices of Local 588 UFCW. The president is John Heise who is also is in management of UFCW Local as the grievance coordinator.

· It is rumored that the union jet has been used for golf junkets, other commingled business dealings and “semi-working vacations”.

2004 LM’2

· Schedule 6 on Page 15 of our 2004 LM’2 lists the sale of an investment/fixed asset. The Investment/fixed asset cost $4,267,023 and was sold for $1,125, 000. This is suspicious to say the least. Where did this money go?

· Key staff members have been give large allowances and disbursements for years.


In Conclusion

This is a local union in the complete control of the Loveall family. All the top positions are controlled by the Lovealls, various Loveall family members control the Executive Board and there are many interlocking family relationships among the staff.

This is a local leadership that has completely run amok and has literally run over members come election time in pulling out all the stops in every contested election to this day (which is a whole other series’ of stories unto itself).

We feel that it is near impossible to produce movies, run a non-profit foundation, an online marketplace, real estate ventures (these are said to go far deeper that what we as members can get our arms around), put together a casino venture and run a union without the commingling of union resources with these ventures. The totality of all of this leads us to believe that our local is being used for a host of other activities not connected with our mission.

We request that you conduct a compliance audit of our books to see if any criminal conduct has occurred in the commingling of our dues with other outside ventures being run by our leadership.

We also request that the OLMS conduct an embezzlement investigation in connection with the 3 million dollar loss on our 2004 LM-2 and the huge expenses paid to staff over the years thru allowances and disbursements.
