Weekly Report: On Israeli Human Rights Violations in the Occupied Palestinian Territories

Israeli Occupation Forces (IOF) Continue Attacks in the Occupied Palestinian Territory (OPT)

· Three Palestinians, including two children were killed by IOF.

· 18 Palestinian civilians, including 4 children and a journalist, were injured by IOF.

· IOF fired at Palestinian civilians demonstrating in protest to the construction of the “Annexation Wall” in the West Bank and wounded 10 civilians.

· IOF conducted incursions into Palestinian areas.

· Houses were raided and 10 Palestinian civilians were arrested by IOF.

· Israeli settlers have continued to attack Palestinian civilians and property in the West Bank.

· IOF have continued expansion of settlements.

· IOF have continued to impose a total siege on the OPT; IOF positioned at checkpoints and border crossings arrested eight Palestinian civilians and IOF have continued to use a special checking machine at Rafah International Crossing Point.




Introduction

Israeli Occupation Forces (IOF) continued to launch attacks on Palestinian civilians and property in the Occupied Palestinian Territory (OPT). This week, human rights violations perpetrated by IOF included shooting at Palestinian civilians, incursions into Palestinian areas, house raids and arbitrary arrests. In violation of international law and specifically international humanitarian law, IOF have also continued to construct the “Annexation Wall” inside the West Bank territory. They have also continued to impose severe restrictions on the movement of Palestinian civilians.



This week, IOF used three Palestinian civilians as human shields in military operations in the OPT.



This week, IOF killed three Palestinians in the West Bank, including two children. On Monday morning, IOF killed killed Shafiq 'Abdul Ghani, 34, in Saida village near Tulkarm. On 4 May 2005, IOF shot dead two Palestinian children from the 'Aassi family in Beit Liqia village near Ramallah. The children were with a number of Palestinian civilians who were throwing stones at the IOF.



This week, IOF conducted at least 16 military incursions into Palestinian areas in the West Bank, including the Palestinian controlled town of Tulkarm. The widest of these incursions was into Saida village near Tulkarm (resulting in the death of a Palestinian civilian) and into al-Fawar refugee camp near Hebron (resulting in the injury to seven Palestinian civilians). During other incursions, IOF injured 8 Palestinian civilians, including four children, and arrested 10 others.



An Israeli Military Court issued a ruling on Tuesday, 3 May 2005, ordering an Israeli officer who was responsible for killing a Palestinian child, 3-year-old Mohammed Jaradat, to serve the army four of ‘disciplinary works’. The child was killed on 25 July 2003, when an Israeli tank fired at him near Barta'a village, southwest of Jenin, before the eyes of his mother and grandmother. The punishment once again demonstrates the impunity granted to the IOF by the Israeli judiciary.



Construction of the Annexation Wall in the West Bank was suspended this week due to the religious holidays in Israel. However, violations relating to the construction of the Wall continued. The IOF used force to disperse peaceful demonstrations organized by Palestinian civilians in protest to the construction of the Wall. On Sunday evening, 1 May 2005, IOF fired upon demonstrators in Bal'ein village, west of Ramallah, and wounded 10 persons, including a journalist. According to local sources, IOF used new rubber-coated metal bullets in the incident, which are round and penetrate flesh.



Israeli settlers living in the OPT in violation of international humanitarian law continued to attack Palestinian civilians and property. On Thursday morning, 28 April 2005, IOF started to raze areas of Palestinian land, which were confiscated on 11 March 2005, in Deir al-Hatab village. IOF claimed that this land was confiscated for military purposes but in fact the land was confiscated to expand the neighboring "Allon Moreh" settlement. On Tuesday morning, 3 May 2005, IOF ordered residents of pastoral areas to the east of Tammoun village, southeast of Jenin, to vacate their homes and animal farms and demolished them. Israeli settlers also launched a series of attacks against Palestinian civilians and property in Hebron.



IOF have continued to impose a tightened siege on the OPT, including Jerusalem. On Tuesday, 3 May 2005, IOF lifted the comprehensive closure imposed on the West Bank since Thursday morning, 21 April 2005, excluding the northern area. Despite this the IOF continued to impose severe restrictions on the movement of Palestinian civilians throughout the reporting period including the following restrictions:

· They have continued to close Za'tara checkpoint near Nablus for the second consecutive week.

· They also erected a number of sudden military checkpoints where they stopped and checked Palestinian civilians and arrested seven persons.



In the Gaza Strip, IOF have continued to completely or partially close all border crossings of the Gaza Strip, and impose severe restrictions on the internal movement of Palestinian civilians:

· They have continued to close Erez crossing in the northern Gaza Strip for the second consecutive week.

· They have continued to impose severe restriction at checkpoints on the main road in the Gaza Strip.

· IOF have continued to use a special checking machine at Rafah International Crossing Points, despite warnings from the Palestinian National Authority and human rights organizations of its dangers.















Shelling of and Encroachment into Palestinian Areas and Attacks on Palestinian Civilians and Property



Thursday, 28 March 2005

· At approximately 01:00, IOF moved into Nablus and the neighboring Balata village and refugee camp. They raided and searched a house belonging to the family of Mohammed Tawfiq al-Riahai, 25, and arrested him.

· At approximately 11:00, IOF moved into al-Sawana area in the south of Tulkarm. They patrolled inside the area and erected a checkpoint at its entrance. No arrests were reported.

· Also at approximately 11:00, IOF moved into Shoufa village, south of Tulkarm. They patrolled in the village and erected a checkpoint on the road leading to it. No arrests were reported.

· At approximately 16:00, IOF, accompanied by an Israeli Police Unit, moved into al-Zahiriya village, south of Hebron. They raided a number of shops in Wad al-Ghari area in the south of the village. They also erected a number of checkpoints and stopped and searched dozens of Palestinian civilian vehicles. Further, they set fire to two shops of car parts. Before their withdrawal from the village, they arrested Musallam Nayef Nasrallah, 27.



Friday, 29 April 2005

· At approximately 02:00, IOF moved into Seilat al-Zaher village, south of Jenin, and imposed a curfew. They also erected a number of checkpoints at its northeastern and southwestern entrances. They stopped and searched Palestinian civilian vehicles. No arrests were reported.

· At approximately 03:00, IOF moved into al-Fawar refugee camp, south of Hebron. They raided and searched Ahmed Mustafa al-Najjar's house. They forced the 13 residents out and summoned two of the owner's son for interrogation: Amjad, 25; and Mohammed, 22 (who was not home). On the following day, IOF raided the house again and arrested him.



Saturday, 30 April 2005

· At approximately 18:30, IOF moved into al-Fawar refugee camp, south of Hebron. They raided and searched a number of houses in the northeast of the camp. At approximately 20:30, dozens of Palestinian civilians gathered and threw stones at IOF. Immediately, IOF opened fire at the stone throwers, wounding five of them, including four children:

Mohammed Ahmed Abu Sil, 16, wounded by a live bullet in the right knee;
Sayaf Kamal Abu Tu'aima, 13, wounded by shrapnel in the left eye;
Fares Mohammed Tubasi, 23, wounded by a rubber-coated metal bullet in the left arm;
Sameer Ahmed Tubasi, 21, wounded by a rubber-coated metal bullet in the right hand; and
Nour 'Abdul Hadi al-'Anani, 4, wounded by two rubber-coated metal bullets in the face and the left thigh.
· In addition, 8-year-old Ibrahim Mohammed al-Sarahna suffered from tear gas inhalation, and 14-year-old Mahmoud Khalil Rabee' sustained serious bruises in the right leg after he had been beaten by IOF.



Sunday, 1 May 2005

· At approximately 01:00, IOF moved into Tammoun village, southeast of Jenin. They patrolled in the streets and erected a checkpoint at the northwestern entrance of the village. They stopped and searched Palestinian civilian vehicles. They also erected a checkpoint at the northeastern entrance of the village and prevented Palestinian farmers from going to their agricultural land in the Northern and Central Jordan Valley. No arrests were reported.



Monday, 2 May 2005

· In the early morning, IOF moved into Saida village, north of Tulkarm, to arrest an allegedly wanted Palestinian. Two members of the Palestinian resistance exchanged fire with IOF. One member was killed and the other was arrested. The IOF claimed that they had searched for the victim for a long time because he was planning to carry out and armed attack.

According to investigations conducted by PCHR, at approximately 02:00, IOF, reinforced by a helicopter, moved into the northeastern part of Saida village. At approximately 04:00, an exchange of fire was heard in the area. At approximately 05:00, IOF imposed a curfew on the village. Later, dozens of Palestinian civilians gathered in the center of the village and threw stones at IOF. Immediately, IOF fired at the stone throwers, wounding two:

1. Mo'tassem Zaidan 'Abdul Ghani, 19, wounded by a live bullet in the right leg; and

2. Tariq Adeeb Raddad, 17, wounded by a rubber-coated metal bullet in the nose.

Later, IOF stated that they killed Shafiq 'Awni Mustafa 'Abdul Ghani, 34, in an exchange of fire. According to eyewitnesses, the victim was hit by several live bullets throughout the body at close range. The victim was the leader of al-Quds Brigade, the military wing of the Islamic Jihad, in Tulkarm. He was married and a father of four children. IOF also arrested 'Abdul Fattah Raddad, 25.



· Also at approximately 02:00, IOF moved into the Palestinian controlled Tulkarm town. They raided and searched a house belonging to the family of Mohammed Jamal Ghanem, 19, and arrested him. They beat him in front of his family.

· At approximately 02:30, IOF moved into Hebron. They raided and searched a house belonging to the family of Fadi Mohammed al-Rujbi, 19, and arrested him.

· Also at approximately 02:30, IOF moved into Marrish village, west of Hebron. They raided and searched a house belonging to the family of Ussama Hussein Shahin, 25, and arrested him.

· At approximately 03:00, IOF moved into Housan village, west of Bethlehem. They raided and searched a number of houses and arrested three Palestinian children:

Samer Mohammed Sabatin, 17;
Khalil Mohammed 'Olayan, 17; and
Mohammed 'Eissa Sabatin, 17.
· Also at approximately 03:00, IOF moved into 'Ein al-Baida village, north of Jenin, and imposed a curfew. No arrests were reported.

· At approximately 16:00, IOF moved into Toubas village, southeast of Jenin. They erected a number of checkpoints at its entrances. They stopped and searched Palestinian civilian vehicles. No arrests were reported.



Wednesday, 4 May 2005

· In the evening, IOF shot dead two Palestinian children in Beit Liqia village, west of Ramallah. They claimed that they fired at the children after around 300 Palestinians began to throw stones at Israeli machines used in the construction of the Annexation Wall. An Israeli military spokesman further claimed that the "Palestinians surrounded a small Military Unit in the area and that Israeli soldiers first fired rubber-coated metal bullets at them but it was not helpful, so they fired a live bullet in the air. It was also not helpful and the soldiers felt that their lives were threatened, so the Officer fired at the lower part of the body of one of the demonstrator. He saw that he was wounded but he did not know whether other demonstrators were wounded."

Investigations conducted by PCHR refute these claims and prove that IOF used excessive force against the demonstrators.

According to investigations conducted by PCHR, at approximately 19:30, dozens of Palestinian children and young men finished a football match on a playground in Beit Liqia village. The playground is nearly 500 meters away from the Annexation Wall. When they left the playground, they saw 12 Israeli military jeeps escorting machines that were constructing the Wall in the area. They threw stones at the jeeps. Soon, an Israeli military helicopter was seen airdropping 10-12 Israeli soldiers near a crossroads leading to the neighboring Beit Nouba village. Those soldiers moved to the south and together with the jeeps surrounded the stone throwers. Then, they opened fire at the stone throwers, wounding two children. The two children were evacuated in a civilian car to a clinic in the neighboring Biddu village but they died five minutes later. The victims were identified as:

1. 'Udai Mufeed 'Aassi, 16, hit by a live bullet to the chest; and

2. Jamal Jaber 'Aassi, 16, hit by a live bullet to the chest.



Tuesday, 3 May 2005

· At approximately 20:00, IOF moved into Saffa village, west of Ramallah. They opened fire at houses. Then, they raided and searched a number of houses and arrested 17-year-old Zaki Mansour, who was wounded by a rubber-coated metal bullet in the left eye when he was participating in a peaceful demonstration against the construction of the Annexation Wall one month ago.



Continued Siege on the OPT

IOF have continued to impose a tightened siege on the OPT and imposed severe restrictions on the movement of Palestinian civilians in the Gaza Strip and the West Bank, including Jerusalem.



Gaza Strip

IOF have continued to impose severe restrictions on the movement of Palestinian civilians through al-Matahen and Abu Houli checkpoints on Salah al-Din Street (the main road between the north and south of the Gaza Strip), even though they have increased the hours of opening the two checkpoints. They often close the two checkpoints and hold and check Palestinian civilians in between. On Thursday morning, 28 April 2005, IOF reopened the two checkpoints for two hours following a two-day closure. IOF reopened the two checkpoints at 21:00 on Thursday.



IOF have also continued to impose a strict siege on al-Mawasi area in the southern Gaza Strip. Male Palestinians aged 16-35 have been prohibited from crossing al-Tuffah checkpoint at the entrance to the area. IOF allow the entry of foodstuffs into the area on Saturdays and Sundays, and allow the entry of other goods on Tuesdays and Wednesdays. On other days, they allow the transportation of agricultural products out of the area. IOF and settlers have continued to attack Palestinian civilians and property.

IOF have also continued to close a number of roads inside the Gaza Strip since the beginning of the current Intifada, such as the western Rafah – Khan Yunis road in the southern Gaza Strip, Abu al-'Ajeen road between the villages of al-Qarara and Wadi al-Salqa in the central Gaza Strip and Salah al-Din Street at "Netzarim" and "Kfar Darom" junctions in the central Gaza Strip. Furthermore, IOF have continued to prohibit Palestinian civilians from using "Kissufim", "Morag" and al-Mentar roads in the southern and central Gaza Strip, which have been devoted for the movement of IOF and settlers. IOF have continued to close Gaza International Airport for the fourth consecutive year.



IOF have continued to impose a strict siege on Palestinian communities located near Israeli military posts and settlements, particularly al-Sayafa area between "Dogit" and "Elli Sinai" settlements in the northern Gaza Strip. In the same context, IOF have continued to impose a strict siege on al-Ma'ni area near "Kfar Darom" settlement in the central Gaza Strip.

IOF have continued to close Beit Hanoun (Erez) crossing in the northern Gaza Strip for the second consecutive week, prohibiting access of dozens of Palestinian workers to their work places in Israel and several patients to hospitals.



IOF have continued to impose severe restriction on commercial transactions at al-Mentar (Karni) commercial crossing, east of Gaza City. Even though, IOF have declared that they would ease these restrictions, they have allowed only 30-35 trucks to enter Israel through the crossing and 270 to enter the Gaza Strip from Israel. The crossing is operated at a very limited capacity, which has damaged goods and caused large financial losses to Palestinian traders.



Even though Rafah International Crossing Point on the Egyptian border is open, IOF have continued to impose severe restrictions on travel. The crossing point is opened from 09:00 to 17:00 everyday. Even though, IOF have allowed Palestinians aged 16-35 to travel through the crossing since 20 February 2005, they have continued to summon and interrogate a number of these Palestinians. IOF have continued to use a special checking machine, which causes health problems despite Palestinian protests, the latest of which was the suspension of work at the crossing point on 26 April 2005. IOF first stopped using it on 6 April 2005, following protests by human rights organizations and the Palestinian National Authority. On 2 May 2005, IOF arrested Nizar Rabah Kuhail, 37, from Gaza City, when he was on his way back to the Gaza Strip. Rafah International Crossing Point has been the only outlet for Palestinian civilians in the Gaza Strip to the outside world since the beginning of the current Intifada.



The West Bank

IOF have continued to impose a strict siege on Palestinian communities. They have also imposed severe restrictions on the movement of Palestinian civilians and imposed curfews on a number of Palestinian communities.



Jerusalem

IOF have continued to impose severe restrictions on the movement of Palestinian civilians. They imposed a total closure on the city during Passover Holiday . They have prevented Palestinian civilians, including even those who have valid permits to enter Israel, from entering the city. Thousands of Palestinian Christians were denied access to the holy sites in Jerusalem during the Easter.



Hebron

IOF have continued to impose severe restrictions on the movement of Palestinian civilians inside the town, especially around the Ibrahimi Mosque and the old town. On Friday, 29 April 2005, hundreds of Palestinian civilians were not able to reach the Ibrahimi Mosque. IOF have continued to close a square in the center of the town with barbed-wire.



Nablus

IOF have continued to close Za'tara checkpoint, south of Nablus, for the second consecutive week. They have prevented Palestinian civilians from crossing it, excluding humanitarian cases. This week, IOF erected several spontaneous checkpoints on the roads leading to the city. They have also continued to prevent Palestinian civilians aged 16-25 from crossing checkpoints without "checkpoint permits."



Tulkarm

At approximately 08:00 on Friday, 29 April 2005, IOF erected a checkpoint at Qiffin crossroads, north of Tulkarm. They obstructed travel of Palestinian civilian vehicles towards Jenin. On Saturday morning, 30 April 2005, IOF closed al-Kafriyat cvheckpoint, south of Tulkarm.



Qalqilya

On Friday morning, 29 April 2005, IOF erected a checkpoint near 'Azzoun village on Qalqilya – Tulkarm road. They held and interrogated a number of Palestinian civilians. On Tuesday morning, 3 April 2005, IOF erected a number of checkpoints on the roads leading to the town. They stopped and searched dozens of Palestinian civilian vehicles.



Arrests and Attacks on Palestinian Civilians While Crossing Military Checkpoints



Thursday, 28 April 2005

· IOF erected a checkpoint in Beer al-Maa' area on the road between Beit Sahour al-'Obaidiya village, east of Bethlehem. They stopped a car and arrested Nidal al-Huziabi, 45, and his nephew Firas Mohammed al-Huzaibi, 29.

· In the morning, IOF positioned at al-Shuhada Street in the center of Hebron stopped 13-year-old Adham Zahda and severely beat him for no apparent reason. He sustained two fractures in the left hand.

· At approximately 08:00, IOF positioned at a checkpoint to the south of Hebron stopped a Palestinian worker, Ahmed Warasna, 24, from al-Shyoukh village, when he was traveling to his work place in Israel, and severely beat him. He sustained bruises throughout the body.



Sunday, 1 May 2005

· At approximately 16:00, IOF positioned at a military checkpoint near "Oufra" settlement, northeast of Ramallah, arrested 'Abdul Rahman Mohammed Hamada, 27.



Monday, 2 May 2005

· At approximately 08:00, IOF positioned at Beit Fourik checkpoint, east of Nablus, severely beat three Palestinian civilians, including a girl:

Nidal 'Abdul Latif Hanani, 22;
Murad 'Abdul Latif Hanani, 25; and
Mai Hanani, 18, Murad's fiancée, all from Beit Fourik village.
They also arrested the first two civilians.



· At approximately 20:00, IOF erected a checkpoint near al-Fawar refugee camp, south of Hebron. They stopped and searched a number of Palestinian civilian vehicles and attested two Palestinian civilians:

Yasser Mahmoud al-Weraidat, 32, from al-Zahiriya village; and
Mohammed Mahmoud 'Amaira, 28, from al-Burj village.


Attacks by Settlers against Palestinian Civilian and Property

Israeli settlers living in the OPT in violation of international humanitarian law have launched a series of attacks against Palestinian civilians and property. IOF have continued to confiscate areas of Palestinian land for settlement activities.



On Thursday morning, 28 April 2005, IOF started to raze areas of Palestinian land, which were confiscated on 11 March 2005, in Deir al-Hatab village. IOF claimed that this land was confiscated for military purposes, but in fact it was confiscated to expand the neighboring "Allon Moreh" settlement. IOF also established a road leading to the aforementioned settlement and placed around 15 tents on the land. The area of this land is estimated at 165 donums and it belongs to Palestinian civilians from Nablus.



Also on Thursday, a number of Israeli settlers from "Ramat Yishai" settlement post in Tal Rumaida neighborhood in the center of Hebron severely beat Ma'moun Ta'ma Abu Rumaila, 20, when he was grazing animals near his house. He sustained bruises.



On Friday morning and noon, 29 April 2005, Israeli settlers living in "Ramat Yishai" settlement post in Tal Rumaida neighborhood in the center of Hebron attacked Palestinian civilians and property. They threw stones, bottles and garbage. They tried to break into Mohammed Hamed Abu 'Eisha's house in the center of the neighborhood. These attacks took place while members of the Israeli military stood by and watched.



On Friday and Saturday, 29 and 30 April 2005, Israeli settlers living in "Sousia" settlement, south of Hebron, launched a series of attacks on Palestinian civilians living in the neighboring Sousia village to prevent them from reaching their agricultural land near the aforementioned settlement. For instance, on Friday afternoon, 29 April 2005, an Israeli settler severely beat Wadha Mohammed al-Nawaja'a, 60, when she tried to prevent him from entering an olive field with cattle. She sustained bruises and injuries in the face and the back.



On Tuesday morning, 3 May 2005, IOF ordered residents of pastoral areas to the east of Tammoun village, southeast of Jenin, to vacate tin-made homes and animal farms in order for them to be demolished. At approximately 12:00, they demolished these homes and animal farms.



Also on Tuesday, a number of Israeli settlers from "Ramat Yishai" settlement post in Tal Rumaida neighborhood in the center of Hebron attacked Mohammed Hamed Abu 'Eisha's house. They threw stones and empty bottles at the house. As a result, Tayseer Abu 'Eisha, 42, sustained bruises in the hand.

Recommendations to the International Community

1. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to fulfill their legal and moral obligations under article 1 of the Convention to ensure Israel's respect for the Convention in the Occupied Palestinian Territory. PCHR believes the conspiracy of silence practiced by the international community has encouraged Israel to act as a state above law and continue to violate international human rights and humanitarian law.

2. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to convene a conference to take effective steps to ensure Israel's respect of the Convention in the OPT and to provide immediate protection for Palestinian civilians.

3. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to comply with its legal obligations detailed in article 146 of the Convention to search for and prosecute those responsible for grave breaches, namely war crimes.

4. PCHR recommends international civil society organizations, including human rights organizations, bar associations and solidarity groups to participate in the process of searching for Israeli war criminals and to urge their governments to bring these war criminals to justice.

5. PCHR calls upon the European Union to activate article 2 of the Euro-Israel Association Agreement, which provides that Israel must respect human rights as a precondition for economic cooperation between the EU states and Israel. PCHR further calls upon the EU states to prohibit import of goods produced in illegal Israeli settlements in the OPT.

6. PCHR calls upon European governments to change their positions towards the Palestinian cause at UN bodies, particularly the General Assembly, Security Council and Commission on Human Rights.

7. PCHR welcomes the UN General Assembly resolution, which referred the issue of the Separation Wall inside the OPT to International Court of Justice to give its Advisory Opinion. There is no doubt that the wall is illegal, which obligates the international community to take steps that amount to the level of the expected decision by the court.

8. In recognition of ICRC as the guardian of the Fourth Geneva Convention, PCHR calls upon the ICRC to increase its staff and activities in the OPT, including for facilitating family visitations to Palestinian prisoners in Israeli jails.

9. PCHR appreciates the efforts of international civil society, including human rights organizations, bar associations, unions and solidarity groups, and urges them to continue their role in pressuring their governments to secure Israel's respect for human rights in the OPT and to end its attacks on Palestinian civilians.

10. In light of the severe restrictions imposed by the Israeli government and its occupying forces on access of international solidarity groups to the OPTs, PCHR calls upon European countries to deal the same way with Israeli citizens.

11. PCHR reiterates that any political settlement not based on international human rights law and humanitarian law cannot lead to a peaceful and just solution of the Palestinian question. Rather, such an arrangement can only lead to further suffering and instability in the region. Any peace agreement or process must be based on respect for international law, including international human rights and humanitarian law.
