Harbor Island in Court Next Week (In Court On Oct 14)
By Ed Moser
The city of Alameda’s lawsuit against the owners of the Harbor Island apartments will be brought before a federal judge next Thursday in San Francisco, to decide the fate of some 150 residents still living at the complex.
The city is asking for a temporary restraining order to prevent a mass eviction of tenants at the West End apartments, which is scheduled to take place Nov. 3. City Attorney Carol Korade said the court gave this case an early hearing because of the Nov. 4 deadline.
“(The court) recognized the serious risk and urgent need to get this case heard,” Korade said. “The federal court expedited their calendar and made this a top priority.” Korade said cases aren’t typically heard so fast. “I’m amazed how fast they’ve been,” she said.
This type of lawsuit against a landlord has never been argued in front of a judge, Korade said.
The suit alleges that the evictions constitute an unfair business practice. The suit says, “150 of Alameda’s most vulnerable families face homelessness after years of paying excessive rents for substandard housing.”
