Scott Weiner's original conservatorship bill, SB-1045, allowed San Francisco to “conserve”, (detain and forcibly treat) homeless people with mental illness and substance abuse, if police sent them to Psych Emergency eight times in twelve months. The Voluntary Services First Coalition opposes this bill, saying it’s another form of homeless criminalization and does nothing to solve the homelessness problem. What we need to do is provide supportive housing and mental health/substance abuses to all who need it.
As SB-1045 was in Sacramento in 2018, civil liberties and disabilities groups opposing SB 1045 successfully pressured the legislature to add some protective clauses to SB-1045. It’s turning out that these clauses are now restricting the potential conservatees in San Francisco to 5-10 people. So Weiner is now sponsoring SB 40, which would remove some of these protective clauses to cover more people and make it easier to conserve them; in effect moving the goalposts to try to rescue a fundamentally flawed bill.
