Governor Jerry Brown supports blacklisting system by failing to sign AB 2819

Oakland - Governor Jerry Brown has screwed the renters of California again because he failed to sign AB 2819 into law by September 30. It is apparent that Governor Jerry Brown is a wealthy landlord who protects other wealthy corrupt landlords and apartment associations that discriminate against tenants by blacklisting them with unlawful detainer eviction notices that are on record with the U.D. Registry, and other profiteering credit reporting agencies.

According to public records, staff in the Housing and Community Development Department advised that there were about 12,050 termination notices (eviction notices) served in Oakland from January 1, 2015 through March 2016. Not only have these poor souls been evicted from their housing and dumped onto the cold streets of Oakland, making matters worse is that each and everyone one of them have been blacklisted by a brutal system for the next 7 years. Even if the tenants won in court against the eviction (unlawful detainer) because it may have been an unlawful eviction, the unlawful eviction will be listed in their credit report for the next 7 year. This is unfair, and unjust, because landlords use this eviction information as a way to discriminate against renters, and the law needs to be changed to bring these unfair business practices to an end.

In Sacramento, a tenant who became homeless spoke up in support of AB 2819 against the U.D. Registry and landlords who retaliate against tenants for fighting back against unlawful evictions, with the unfair blacklisting system.

As a result of the efforts of a 16 year old student, now comes AB 2819, which has plenty of support including support in the assembly and the senate, but Governor Jerry Brown refused to sign AB 2819 into law.

AB 2819 offered protection from tenant blacklists — According to it’s sponsors, if signed into law, AB 2819 would have prevented innocent tenants facing an eviction lawsuit from having their credit tarnished and future housing opportunities jeopardized by keeping tenants’ court records private unless the landlord prevails in the lawsuit. Under current law, tenants are blacklisted if their cases are not resolved within 60 days, even if they ultimately win the lawsuit.

The current tenant blacklisting system needs to be abolished and Governor Jerry Brown supports the tenant blacklisting system by failing to sign AB 2819 into law.

Hi Lynda –

I’m the main advocate in Sacramento working on AB 2819 (Chiu), which would reform the law regarding sealing of eviction records. I received a link to the piece on the bill that you posted on IndyBay. Thank you for your support! Rest assured that the bill still has an excellent chance of being signed into law.

While AB 2819 was passed by the state Senate on August 15, it didn't get to Gov. Brown until August 22. Until then, it was in engrossing & enrolling (essentially, making sure the statutory text is correct - see http://clerk.assembly.ca.gov/office-engrossing-and-enrolling), which is quite normal. The Assembly had by then issued a Constitutional interpretation of the 12 day rule, which provided that the Governor had until September 30 to consider bills that reached him after August 21. So the fact that the Governor hasn’t yet signed the bill doesn’t indicate that he will veto it.

We have received positive signals from his staff, and I’m optimistic (though of course not certain) that it will be signed.
