Half a dozen cited, photographer arrested at Freedom Sleepers Protest
At midnight, ten police officers converged on 20 Freedom Sleepers at City Hall, some awake with petitions on the public accessway, some asleep on the grass. The officers refused to respect the right to view public agendas posted at City Hall, or the language of the "Park Closing" law. Sleepers angrily objected to the demands of police that they leave, most going to the sidewalk. Two were given additional Stay-Away orders for 24 hours. Israel Dawson, a UCSC photographer was handcuffed and arrested for "not identifying himself" and "walking away" according to the officer who took him. We are continuing our protest--our 5th night here on the sidewalk, determined to rouse the conscience of the community against the Sleeping Ban.
This is a short account because I'm writing on a laptop that has little battery power left.
This was the most intrusive and aggressive police response yet. On the positive side, the activists--angry at the arrest of an innocent photographer--returned to the "park"--with the intention of forcing police to withdraw or arrest them. Police, apparently after conferring with sheriff's deputies, by one observer's account, may have been advised that the jail authorities weren't interested in taking a dozen or more people into custody.
No one was injured and no property taken, that I'm aware of. However police ignored the wording of MC 13.04.011, which exempts passageways through "parks"--on which I, for one, was standing.
They also declined to suggest a legal place tonight for homeless people (who made up half our group) could go.
Freedom Sleepers speakers read the text of the Department of Justice statement supporting the homeless right to camp in Boise, Idaho. In response Mayor Don Lane but off Oral Communications before 10 people in line could speak.
Meanwhile the Freedom Speakers, angered by the unconstitutional and unnecessary police intimidation continue to sleep on the sidewalk and plan to return in greater force next Tuesday.

This BULLSHIT is short lived. The feds have made it clear that the criminalization of the poor and houseless is going to come to an end in America. In the meantime SCPD arrest ppl for sleeping while gang bangers and drug dealers dominate the Westside of Santa Cruz! These are the REAL public safety hazards not the ppl trying to get a night’s sleep so they can be functional to try to pull themselves out of homelessness!

Santa Cruz police are becoming as heartless as the laws.
A person has to have an option to be law abiding. If sleeping on public and private property is against the law, and a person has to sleep, it forces a person into being a criminal.

I know that makes it hard to believe they can read legal documents, but I'm posting the STATEMENT OF INTEREST OF THE UNITED STATES in JANET F. BELL, et al., v. CITY OF BOISE, et al.here so they can't say they weren't warned. We'll be back next week guys. I know you see it as 'job security', but in the long run, the city will need a WHOLE LOT LESS of you b/c there simply won't be any homeless-harassment ordinances anymore which is the the way you and your blackshirt security guard BFFs seem to spend the majority of your shifts.

Governor Jerry Brown has just passed this: "The Democratic governor announced Tuesday that he signed SB411 by Democratic Sen. Ricardo Lara of Bell Gardens, clarifying that recording police is not sufficient cause to charge people with obstruction of justice."
I know not the same as your experiences in SC, but they(Santa Cruz Police) are probably facing some very severe legal problems.
