Just to make the issue clear.
SOME of us consider a person "unarmed" if they are carrying an unloaded firearm or a replica firearm or an extremely realistic toy "firearm".
OTHERS of us, and possibly the legal jurisdiction might considered the person "armed" (for example, might make a difference between "unarmed robbery" and "armed robbery" -- I don't know what the rules for CA are but in my jurisdiction if a "pretend weapon" is shown in a robbery makes it "armed robbery" even if that wasn't a functional weapon.
Please correct me if I am wrong, but isn't THAT the issue in this case? A pellet gun that was a realistic replica of a real weapon?
