Dina Padilla, P&F Insurance Commission Candidate Demands Prosecution Of Workers Comp Fraud
Dina Padilla, the Peace and Freedom Party candidate for Insurance Commissioner challenged the criminal fraud against injured workers and the public at the California Fraud Assessment Commission in Sacramento on September 8, 2010. She also challenged the testimony of Yolo County Lt. Daniel Stroski who testified that he did not know what "employee rights are."
Peace and Freedom Party Insurance Commissioner candidate Dina Padilla challenged the on going corruption by crooked employers, the insurance industry and officials in the Department of Insurance and DA's who refuse to prosecute fraud. This statement was made at a hearing where the Fraud Assessment Commission voted to falsify the minutes of a previous meeting over the role of Insurance Commissioner Lilia Garcia. Garcia at the previous meeting had said she was an employer representative and at the Sept 8, 2010 she now testified that she was a labor representative.
The commission voted to change the minutes of the last meeting to cover up the real hearing record.

Starting with the first visit to the FAC, in 10-2-05 and every year since, that the 9-8-2010, became clearly evident that the FAC's only interest is to fund District Attorney's of Ca. counties with out listening to the objections of injured workers advocates or myself, Ca. Candidate for Insurance Commissioner. At every Autumn hearing, IT IS an automatic foregone conclusion that a budget WILL be passed.
The longest conversation in this FAC's last hearing, 9-8-2010 was on on how much money would go to the 2011-2012 budget.
I had previously, via email to the FAC-Chair, Lisa Middleton dared to ask for more time to address the POWAY Toyota workers that were exposed to mold but I was denied more time than the usual 3 minutes for " public comment" . Tim Hackway and other employees was continually exposed to mold but Toyota's attorney's served a Restraining Order on Tim, to not speak about the mold issues at Toyota, on the internet and other public venues.This is just yet the latest attempt & way, by corporations, to deny whistle blower injured workers their rights to the 1st amendment and hide corporate crime. This has happened to another injured worker who was served 9 restraining orders, that were false on their face.
Slapp suits are also used to stop free speech, intimidate, threaten and keep corporate worker comp causations of an inujry but it is used for and to ultimately conspire to keep the employers crimes hidden. Toyota had its management tell Tim to file FMLA-Family Medical Leave Act which is illegal and hence Tim was fired and denied his workers compensation benefits.
Corporations who injure employers are not being prosecuted by any agency and IF the FAC can go after individual injured workers via the astronomically fraud unit budget, then why will they not go after individual injured workers claims for worker comp fraud by the employers who fund the FAC? Then who does? No one at the FAC claims to know. It is supposed to be the DA's funded by the FAC.
The DA's sit in the same hearings and not one of them are standing up to hear and go after irrefutable evidence presented about corporation fraud from injured workers or their advocates?
The FAC asked for 29 million dollars last year but did not spend 6 million of this money, only to carry it over to this year, knowing this year's budget would be difficult to justify an increase considering the "recession"! Lilia Garcia wanted to increase the budget.
There was much discussion over how much money would go to the ins fraud unit. In all of the years I have attended, legislative, FAC-Fraud assessment Commission, DIR-Dept. of Industrial Relations & the CHSWC-Commission on Health & Safety & Worker's Compensation Board, it's all just about the money and not the problems of injured workers or their unhealthy and unsafe working conditions and there are many, the latest being unregulated bio tech companies and building on toxic dump sites like in Downey Ca. or in Sacramento former military bases, federally contract employers like AEROJET, rail road yards or even closed gas stations WHERE people now work & live. A total of over 57 million dollars go to insurance fraud in the state of CA?
In the 2009 BUDGET, for the previous year showed over 23 million for a conviction of 677 individuals including a few small individually owned businesses but no money for prosecution for self -insured employer or any insurance company. One small business owner said 47 cents on the dollar of his money goes for fraud budgets. BUT what most people do not know is that this money is a deductible tax expense for all business owners. SELF-INSURED EMPLOYERS(3000) IN THE STATE OF CALIFORNIA PAY FOR THE FRAUD ASSESSMENT COMMISSION TO PROSECUTE THE CITIZENS BUT NOT THE SELF INSURED EMPLOYERS OR THE INSURANCE COMPANIES. THIS is more than a conflict of interest. purchased immunity for corporations to prosecute against the citizens!
I have been to hearings but THAT have I never heard anything but "that injured workers had hijacked one of the DIR Hearings" conducted by Carrie Nevans. who made that despicable remark. (kaiserpapers.org). Hours of testimony for years and yet it is more about how supposed recommendations or how money is "needed" to fund these boards, commissions and legislative needs but nothing for what injured workers need or as a patient, what they need?
I still want an independent audit of where the money goes, penny by penny, so premium holders not only know but have a right to know how their money is spent. That money is not free money, IT IS OUR MONEY, because it comes out our wages, out of pocket expenses such as co-pays, deductibles, medications, increases, etc.
So, to Ms Lisa Middleton, the chair of the FAC, and the rest of the FAC board, you would not let us talk about the real corporation fraud, but we get to talk about it here for all the public to view & read. Year after year of testimony has been given to the above boards, commissions and legislative hearings and the public has not been given the real truth about the shameful disregard for injured workers who have suffered with no health care or wage replacement and other constitutional, civil & human rights, literally & figuratively, making them sicker and homeless or dead along with the complete destruction of their families.
I hope all those of the public officials can live with themselves knowing they could have helped them but did not. Only to make the injured workers the scapegoats for the public officials existence and justification and millions, to have a job to protect the people but did not.
NOW that is not only a huge waste of tax payer money but totally inhumane.
Here are some reasons to decrease the budget, get rid of boards, commissions and legislators who do not represent the people of the state of California.
BTW, Nevada, tells their citizens that their corporations are going to California and California says our corporations are leaving the state.
That propaganda to take away from the people, comes from the Chamber of Commerce. The people are not in their best interest, only cheap labor that are doomed to get injured on the job.
