The case of the AETA4 is picking up. In recent weeks, their attorneys filed several motions - a motion for jury instructions and the scope of relevant evidence, a motion for a bill of particulars, motions to suppress several illegal and warrantless searches, and several motions to dismiss.

The AETA4 were the first folks arrested under the Animal Enterprise Terrorism Act of 2006. They currently face up to five years in prison for allegedly attending demonstrations in opposition to the University of California's experimentation and torture of live animals. The case promises to be a huge test case for the first amendment.

§AETA4 motion to dismiss to be argued in court

The motion to dismiss for factually insufficiency will be argued in San Jose Federal Court on June 7 by Rachel Meeropol, of the Center for Constitutional Rights.

Oral arguments will be heard on the recent defense motion to dismiss. The motion argues that the indictment is factually insufficient and offers no details, thus not meeting the Russell standard. Please come show your support and please dress conservatively if entering the courtroom.
