To get things started right with our Trial date & the new year, we are calling on all to help set up Rally & a Demo out front of Modesto Courthouse & elsewhere (use imagination) this coming Feb. 1, 2010, to educate the public of the issue at large & stand out as presence & resisting State repression against 2 public health workers that will have almost been in court a year by March 2010 for helping people & reducing disease spread through IV use.A "medical defense necessity" will be determined starting Feb. 1, prior to March 23rd, which is actual starting date for Trial. Please join us & we will provide a lot of signs early that morning for folks that want to hold them out front, or, you are encouraged to make your own.

The Stanislaus County DA was not interested in anything less than a misdemeanor charge against 2 volunteers arrested for offering syringe exchange and harm reduction services in the Airport District in early 2009.
The defendants (Kristy & Brian) were not at all interested in the "deal" offered, which included a 3 year stay away order from Mono Park, 3 yrs. Probation, & 1 defendant, 30 days in county Jail and opted instead to go to jury trial. The trial is scheduled to begin on March 23, 2010 at the Stanislaus County Courthouse.
Whether a necessity defense will be allowed by Judge Cordova will be discussed on Feb. 1. Necessity defense has successfully been used in other notable syringe exchange cases. If you would like to come out and show your support, please do not hesitate - and spread the word.
