Oakland, Ca Fruitvale Bart Station Shooting. Full Video and interview with Karina Vargas
A home video has surfaced showing the events surrounding the shooting death of 22-year-old man by police at a Bay Area Rapid Transit station in Oakland early New Year's day. A copy of the videotape was provided Saturday to CBS 5 by the woman who captured the scene on camera.
Karina Vargas told CBS 5 that she was making the tape available so the public would know what transpired shortly after 2 a.m. Thursday at BART's Fruitvale station when Oscar Grant was shot.
The video, that Vargas said she shot on a brand new camera she received for Christmas, would seem to support previous witnesses accounts that Grant was laying on his stomach with his hands behind him on the train platform when a single shot was fired by a BART officer.
Karina Vargas told CBS 5 that she was making the tape available so the public would know what transpired shortly after 2 a.m. Thursday at BART's Fruitvale station when Oscar Grant was shot.

According to Vargas, Grant was not resisting when the gunshot was fired. Vargas said she was standing only about 5 feet away from the shooting scene. She also said she resisted an officer's attempt to confiscate her camera.
Vargas, who said she was on her way home from a New Year's celebration along the Embarcadero in San Francisco when she witnessed the shooting, contended that Grant's "rights were definitely violated" by police.
BART officials have said Grant was unarmed and implied the shooting was an accident, saying the officer's gun discharged while he and four other officers responded to reports that two groups of young men were fighting on a train that had come from San Francisco and was en route to the Dublin/Pleasanton station.
Grant's family in Hayward has formally hired attorney John Burris to look into the circumstances surrounding his death.
The Oakland attorney, who has filed numerous lawsuits against police departments on behalf of family members of people who have been shot and killed by officers, scheduled a Sunday morning news conference to discuss developments in the case.
"It's an outrageous set of facts. My sense is clear that this was an unjustifiable shooting," Burris said based on witness statements, but prior to the videotape being made public. "There were no movements and he was not trying to overrun the police officer. A gun cannot discharge accidentally, you have to have your finger on the trigger."
"When conduct like this occurs, there is a price to pay," he added. "Police have to be held accountable when they engage in this kind of unlawful conduct."
BART officials have not released the name of the officer who shot Grant. They said the officer has worked for BART for nearly two years and was placed on administrative leave following the shooting.
The Alameda County District Attorney's office is handling the official investigation into the shooting. The D.A.'s office has not commented on the case.

The human thing to do is care enough to not let them take your neighbors, like Karina did by stepping forward to record the arrest. I hope I am that strong next time I see a police stop. Cell phone camera, camcorder, disposable, whatever: if we all recorded every police stop we saw, that would help, but when they kill there are no words or courts that can make it alright. We would be recording so we knew the truth and so the cops knew we were watching. Video tape can't convict a cop, just ask Rodney King, but we can raise the costs when they commit their atrocities. I am so sorry for the family and the daughter. Thanks again Karina.
The police were under a huge amount of stress from the angry mob made apparent by your video. Why were so many people approaching the Police, yelling and screaming at them? Does that mean some one deserved to get shot? No but it's sure easy to see how some thing could have gone wrong. I don't see how this could be called murder, more of an accidental death under a high pressure situation. The police officer who used the fire arm should be prosecuted for sure though for stupidity.
jason, is it an 'angry mob' because they're young black and brown people? violent police activity creates chaos and confusion (and righteous rage for that matter). it looked to me like people we're trying to see what was happening, look out for their brothers, create some kind of check on a police system that brutalizes unchecked, with police officers that commit violent racist acts every day. i was proud to see people trying to see what was happening, since so many of us shy away from police power. check that shit.
There stories have changed a few times since the shooting took place. First they were happy that there was no video footage from the BART cameras then personal videos were released and now they have to stop all communication about the situation. The officer clearly shoots the man in the back in the video. Maybe he was confused and didn't know he had a gun in his hand but that's an accident that will cost BART $25 Million dollars.

I'm a greek riot from athens so excuse my funny english. I's about to give u people an advice. Organize yourselves, inform people somehow, make everyone feel the danger from the police, make things happening.

A friend of Grant’s [the man killed by BART cops] who was with him on the crowded Oakland train station platform at the time of the shooting said Grant pleaded with officers not to harm him.

What has been going on in greece as well as oakland has deeply saddened me as it should everyone. Police have been abusing power for as long as they have been around. These recent deaths in greece as well as in oakland should remind us that we need to show the police they aren't that powerful. We should treat them like they treat us. This was a unfortunate accident that could have been avoided had the officer not gone for his taser/gun in a situation that did not pose a threat. People who are out in the street vandalizing the city of Oakland in protest of the shooting should realize that this is not the way to handle this situation. This officer was sick to pull his gun out. shoot the young man like a deer. Who the hell he thank he is. The other bart officers should arrest him or oakland police. It usually winds up getting swept under the rug without so much as an article in the paper or online- I have witnessed it first hand when they blew a guy away in our backyard in a tree house- NOT ONE ARTICLE ANYWHERE.
WHY?
Because NOBODY HAD IT ON FILM.

The same day to other young black men were shot by police one was suspected of stealing a car he's now in hospital with a bullet in his liver. Another was shot in New Orleans 14 times and twelve of those entered through his back. He was shot by 7 undercover policemen. They were not investing him he was on his way to his families home. The official story is that he fired on them first. This however does not make sense as he has no police record and no way of identifying them as police. Take to the streets and stop trying to act like Greece make your own revolution!
