Judge Grants "Tempoary Restraining Order"

Note: Judge Dombrick was challenged as the original Judge for the case
by attornies John Murcko and Steve Perelson, and Judge Rausch has
replaced Dombrick for case # 08396398.)

--TRO Granted--

Earlier today on July 11, 2008 a TRO (Tempoary Restraining Order) was
granted by Judge Rausch which ordered the owners of the California
Hotel the Oakland Community Housing, Inc., to keep the gas, water and
electricity turned on at the California Hotel. The tenants have been
threatened and told that they needed to move because the gas, water
and electricity was going to be shut off at the California Hotel,
according to the tenants and attorney John Murcko.

An injunction has also been filed to block the unlawful forced
evictions of the tenants who have been told to leave the California
Hotel by July 15, even though they have not received legal eviction
notices.

The hearing for the injunction is set for July 29, according to
attorney John Murcko.

The California Hotel tenants and their supporters are holding a July
14 protest against the Oakland Community Housing, Inc., to demonstrate
against the unlawful evictions taking place at the California Hotel.

On Monday, July 14 (Bastille Day) at 6:00 P.M. tenants at the
California Hotel in Oakland and their supporters will gather at 3501
San Pablo Avenue Oakland to protest the attempt to illegally lock them
out of their housing by their landlord Cahon Associates, and Oakland
Community Housing Inc.

These two slumlords plan to evict all 75 tenants from the California
Hotel on July 15 by shutting off the utilities, and water. The tenants
at the hotel are mostly elderly, disabled persons who are very low
income and have no where else to go.

The landlords are in violation of their agreement with The State of
California Tax Credit Allocation Committee to run a very low income
project for thirty years (1990 to 2020). The State has warned them
against this illegal closure but that has not stopped Cahon Associates
and Charles Fowlks from conducting this illegal action.

Cahon Associates also owns six other properties in Oakland including
San Antonio Terraces, James Lock Courts and others.

These are all scheduled to be closed down and turned into transitional
housing with the eviction of the residents in the future after the
California Hotel is shut down.

This illegal action can be stopped. Fifty tenants of the California
Hotel have filed an action for a injunction.

California Hotel TRO story clarifications...

[Correction -- Correct spelling -- Alameda County Superior Court Judge Frank Roesch -- Department 31. Judge Dombrink (correct spelling) was replaced.]

The following articles below about the California Hotel TRO came out after I posted the above information, and in their pieces below they claim that the court date for the injunction hearing is on July 30, but attorney John Murcko earlier today stated to me that it was on July 29 while on the phone.

I report this information as it comes to me, and the information is so rushed at times that I later realize that there were errors in the information given to me after I double check on it all. My apologies to all for the clarifications needed at times...

So it appears that the hearing for the injunction is on either July 29, or on July 30. Eventually the information will be posted on line on the Alameda County website.

I am wondering if you could tell us what is underlying their claims of running out of money. Everyone is familiar with that big building.
$500 is apparently cheap for this area, however, $500 for a studio is actually market or higher than market for a lot of the rest of the country. I have paid $580 and $600 for quite decent regular studios around here.
So why are their costs so high, particularly when they have lots of small units? Is the building old and requiring lots of special work that they've done, or do they have to pay higher labor than an apartment building in Reno or elsewhere?
If this were anywhere else, I would be saying that they're ridiculous to lose tenants because the coming recession will make it harder to find new tenants as people are forced to double up.

Regarding these expensive $475-$550 SROs that I always wondered about in the Bay Area: Sacramento craigslist has $550 regular studios, on the low end of the range. Portland is $450 on the low end. So what is driving up the costs of the SROs, which are often not so nice.

It is disabled people who are the least moveable. No elderly person, or woman requiring a wheelchair can just put their stuff in a pickup and drive to another area.
OCHIs Claim Of Poverty While Owning So Much Valuable Property, Is Questionable

Oakland Community Housing, Inc. (OCHI), has received funding assistance from numerous state and federal funding sources, including the high rents being charged to their clients (tenants) at the California Hotel. OCHI is a member of the East Bay Housing Organizations (EBHO), whos members also compete for the same funding sources to build their Empires, and often they make their fortunes by displacing the poor with their developments, in the name of creating so-called affordable housing.

Non profit housing organizations receive many special tax exempt breaks that a normal landlord does not receive, and they are even exempt from local rent control laws. At the same time the non profits are pushing to have the California state legislature free up affordable housing funds for their projects that would allow tenants to earn as much as 200% of the local AMI (wealthy renters).

When comparing the rents a so-called non profit charges in a neighborhood, compared to what a for profit landlord charges, sometimes the rents being charged are actually higher than what the for profit landlords are charging.
