Oaxaca January 15th 2008: Youth March for the Liberation Of Political Prisoners

On January 12th and 13th the first APPO Youth Encuentro was held in Zaachila, Oaxaca, Mexico
Among the many Plans of Action agreed upon by the diverse group of young folks, was this march on January 15 for the liberation of political prisoners in Oaxaca. In Particular David Venegas Reyes.
As youth, we declare ourselves in favor of the exit of the illegitimate, assassin, repressor and fascist Ulises Ruiz Ortiz.

-Against the fascist, neoliberal politic, headed by the illegitimate Felipe Calderon and his allies.

-We declare ourselves in solidarity and support of the fighting people of Zaachila.

-For the liberation of all political prisoners in Oaxaca.

-For the presentation, alive, of those disappeared, and a cease to the political persecution of social activists.

-For the punishment of those responsible for the assassinations of our fallen companeros.

-For the return of those exiled and a annulment of invented charges, and conversely, the absolute and unconditional freedom of all those processed.

-Against the militarization of our state.

-Against the militarization of the Zapatista communities in Chiapas.

-In support of the struggle of the Cananea miners.

-In support of the struggle of the "Normalistas" in Ayotzinapa Guerrero.

-In support of the declaration of war made by the Lakota-Sioux against the United States government.

-That those who assume autonomy or popular power here, revindicate the Mesoamerican Indigenous Principles of Unity and Resistance:

-Walk by asking

-Propose, not impose

-Serve, not serve oneself

-Teach by learning

-One no, many yeses

-A world in which many worlds may fit

-We are all equal because we are different

-Everything for everyone, nothing for us

-Lead by obeying

-Exercise power, not take power

-Commonality of people

-Enough is enough

David Venegas Reyes Wins Third Federal Protective Order

Our comrade, friend, and brother in the struggle David Venegas Reyes, also known as Alebrije, has been able to prove his innocence for the third time in federal court for the events of November 25, 2006.

On December 27, 2007, the third protective writ was issued in favor of David. This new writ protects him from a pre-trial detention order issued by the judge at Tlacolula de Matamoros due to a legal trap set on September 18, 2007, which consisted of a “reclassification of offenses,” or, in other words, changing the name of the offenses for which David had been declared innocent two times in federal court.

The following summary briefly describes the steps in the legal situation of our comrade and brother David Venegas Reyes.

IMMEDIATE FREEDOM FOR DAVID VENEGAS REYES,
HAVING OBTAINED HIS THIRD FEDERAL PROTECTIVE ORDER

From the General Labor Confederation, CGT of the Spanish State, we raise our voices to express our alarm to the international public over the current, extraordinary situation of the comrade and political prisoner of Oaxaca, Mexico, David Venegas Reyes.

We want to emphasize that on December 27, 2007, David Venegas was granted his third protective writ by a federal court with regards to the supposed events in which he was implicated on the basis that there were sufficient “reasons” to deprive him of his freedom. With this new order, David’s total, absolute innocence of any crime whatsoever is recognized for the third time, thereby unmasking once again the true, shameful motives for keeping him isolated from his family, his milieu, and his daily life.

The legal proceedings against David V., from the time he was first arrested on April 13, 2007, with concocted evidence on fictitious charges of drug dealing, have proved to be a first-rate political issue for the government of Oaxaca. An unabashedly transformed image of David has consistently been propagated to sell him as a dangerous criminal.

We thereby insist that the unconditional release of David Venegas Reyes, APPO Council member and member of Oaxacan Voices Constructing Autonomy and Freedom, VOCAL, must be immediate, and we denounce the further irregularity that 15 days have gone by since the protective order was granted on December 27––days of anguish and threats with an aftertaste of institutional vengeance for all that David represents. But this time, his release is irreversible.

We hold Ulises Ruiz Ortiz directly responsible for what happens to David Venegas Reyes in the hours to come. There is no other alternative than to respect and accept the federal decision to issue a third protective order decreeing his definitive release without delay.

The year 2007 came to an end in Oaxaca, a long painful year of injustice, repression, forced disappearances, state elections, and death, but also a year of dignified, heroic resistance by many men and women. As powerful forces and politicians benefit from the current state of affairs, they delight in proclaiming the return to peace and quiet in Oaxaca and a reconciliation among its inhabitants, but beneath their speeches, through their dubious, cautious, fearful ––and above all, repressive and violent––– actions, the truth comes out: the social polarization and sharpening of social contradictions is more drastic and more serious than ever. While they speak of peace, their arms, shields and clubs bark of war.
