Zachary Jenson Is A Government Informant

July 20, 2006 Alert
Zachary Jenson is a Government Informant
zachplea.pdf_500_.jpg
Lauren Weiner, Zachary Jenson, and Eric McDavid were arrested in Auburn, CA on Jan 13, 2006 as part of the government's Green Scare campaign. They were charged with conspiracy to destroy property by means of fire or explosives, facing up to 20 years in federal prison for a crime that was never committed.

We at Sacramento Prisoner Support are extremely shocked and discouraged by Zachary Jenson’s decision to ‘take a deal’ and inform on and effectively abandon his remaining co-defendant Eric McDavid. Zachary felt that he could no longer cope with waiting for trial at Sacramento County Jail and has decided to take the same plea agreement that Lauren Weiner took in May, which requires him to “cooperate fully with the government, and any other federal, state, or local law enforcement agency, as the government directs.” His new charges will hold a maximum 5 year sentence, but Zachary will have to live with himself for the rest of his life knowing he abandoned and informed on a friend.

“Cooperation” is explained by the government as Zach being required to cooperate with any law enforcement agency about any issue (not just limited to his case); he must testify before any court or grand jury upon the government’s request, submit to meetings, interviews, or investigations and answer every single question ‘completely’. As per any plea bargain, if Zach fails to meet the strict conditions set out, he will again face his original sentence of up to 20 years in prison.

The full text of his plea agreement can be found at the top of this post in a .pdf file.

We at Sacramento Prisoner Support only support prisoners who do not assist the government in the prosecution of others. We are extremely surprised and pained by Zachary’s decision, as he has repeatedly affirmed that he would never do anything to hurt his co-defendants or take a deal that would require him to become a government informant. His decision came seemingly out of nowhere as he has never expressed any interest in cooperation. Over the past 6 months of his pre-trial incarceration, we never hesitated to do everything possible to support him and maximized our efforts to make sure he felt connected to the outside world, through personally visiting him as often as the jail would allow, making sure he received letters and books, and much more.

As in accordance with our policy, which we continue to stand by, we will no longer support Zachary Jenson, and recommend that others participating in prisoner support do the same. We will now focus our energies on supporting the remaining prisoner from this case, Eric McDavid, who has maintained his innocence from the day he was arrested.

We strongly encourage supporters to write Eric, as he undoubtedly feels betrayed and very alone. As always, please refrain from writing him about his case and issues related to it, as pre-trial detainees mail can be used against them in court. Information on how to support Eric can be found at http://www.supporteric.org

the misanthropic under pinings of much of the radical green milieu play right into this kind of abandonment of comrades and principle. it is sad to see a movement with so much potenial blunder so badly. as long as the lessons of past faux-revolutionary adventurers go unlearned, and some of those jack-asses are held up as learned examples of how to blow up a toliet... well now my cycism is getting the better of me.

don't mourn organize!

It's easier to pass judgement if you are not in their shoes. Imagine facing 20 years, dealing with god-knows-what from the federal gov't that runs Guantomimo and Abu Graihb, and being in a case that has a small hardcore of wonderfull dedicated supporters (thank you Sac Prisoner Support and other Green Scare support activists!), but no mass support yet... It's just sad.

We can learn and avoid actions that are hard to organize public support around and make us and our communities vulnerable to state repression. It does not mean not doing militant direct action, just doing when it is clear, understandable to the public and there is a base of support.

free Eric!

How sad. Folks need to sever any and all contact with Zachary, now and in the future. Irregardless of how you might feel about the circumstances of this betrayal, Zachary now constitutes a serious security threat to everyone. he has ever had contact with, and will remains so for the rest of his life. Publicize this story far and wide.

Any updates on the whereabouts of the agent provocateur 'Anna"?

this is the thing about controversial direct action with no mass support, you end up a target of the state with no mass support, if you are not prepared to land in the clutches of the state and be without any mass support, perhaps it makes more sense to build some mass support and then engage in controversial direct action. This isn't esoteric lefty navel gazing, this is crucial strategy and tactics. We must learn from this or we will see it repeated and we will lose much talent and initiative to this kind of deluded adventuring.

yes. That was sort of an odd target (if the unpublished plea confession is true), if one wanted support of the broader community. There are other institutions which are truly unpopular, and the population has voiced this.

Wow. Some of you are cold, cold people. Please, take a moment to think about the implications of your reaction.

You know the feds are torturing people (both directly and indirectly-- what if they locked him up with a rapist?) And yet, you're ready to dump and brand the guy forever, over some piece of paper the feds handed you. A quick trip to room 101, and their arrestee's support network will abandon him or her forever.

Would-be radical recruits, take note. When the going gets tough, it's sayonara, baby. Enjoy your new roommate.

Should legal support abandon them?

So, some kid gets caught up in one of your "revolutionary" actions, decides that the "revolution" has gone too far and decides to turn states evidence.

Quick! Call him a turncoat, villify him, brand him a traitor! Publish his photo and let others know of his evil!

what are you people talking about. it is SPS policy to only support those who do not help put other people in jail. whats so hard to understand about that. theyre no longer supporting zach jenson because he is actively trying to help put eric mcdavid in jail. it would be a conflict of interest if they continued to support both prisoners. you right wing nuts are stupid.
nobody is commenting on them getting caught up in something radical and then getting abandoned. zach made a choice to act on behalf of the government and sac prisoner support does not supprt that. get over it.
