California Headwater's forest Redwood logging activists, who were subjected to applications of 'Pepperspray' on a Q-tip into the eyes, are suing for civil rights violations in the Federal District Court in San Francisco, CA.

The incidents which occurred in 1997 have caused the plaintiffs to demand honest trials multiple times. The first jury was badly instructed and held, causing another trial with a hung jury.

This third trial is expected to continue until the jury deliberates sometime next week.

Plaintiff Spring Lundberg describes the current state of the case and testimony so far in this interview made the afternoon of April 20, 2005.

David Dubay, the expert science/medical witness for the pepper spray Manufacturer "Defense Technology" reflects the bias of the courts against the plaintiff pepper spray victims. By not allowing a balanced science/medical expert witness to question the safety of the Defense Technology pepper spray oleocapsicum and counteract the bias opinions of Dave Dubay, the courts are ignoring evidence of the countless deaths of prisoners, homeless, protesters and other people who died soon after being sprayed with this product..

It is the belief of this author that one of the reasons a science/medical witness is not allowed to counteract Dubay is that if the safety of the product itself is questionsed, this will lead to numerous other lawsuits against Defense Technology corporation from deaths resulting from pepper sray exposure compounded with asthma, heart attacks, etc..
