ELDERLY RENTER FIGHTING ECONOMIC EVICTION
On Wednesday, September 4, activists, community members and renters shall meet 6:30p.m., at the Temescal Library (Telegraph & 52nd St) to discuss actions to defend Doris Stancil from an unlawful economic eviction.
Ms. Doris Stancil is an elderly disabled woman residing at 35 Monte Vista Ave, for over 10 years. A good tenant, Doris Stancil was one of many elderly renters who resided at the property when she first moved in to that location. Now, she is one of the last after the rest faced evictions.
During the past few months someone has been poisoning the outdoor plants of Ms. Stancil, and repeatedly calling her only to hang up when she answers the phone. She has never had heat in her apartment because Millar (landlord) fails to repair a leaking gas heater, and now being blacklisted by having an eviction on her record, it is a very grim situation.
Ms. Donna Zabazski is the property manager at this location on Monte Vista Ave, working for Bruce Millar who owns around 15 properties.
Recently when seeking repairs from her landlord Bruce Millar for a worn damaged kitchen floor, he made the comment that she payed "cheap rent" and declined to do repairs. Her rent is $658.00 per month. Soon, Ms. Stancil was led to believe that Mr. Millar wanted to raise the rent to $800.00 per month, being way above Oaklands rent cap for annual rent increases. Ms. Stancil then received a 30 Day Notice to move after refusing to pay the illegal rent increase. On Aug 22, Ms. Stancil received an Unlawful Detainer Notice, and a court trial is set for September 10, 2002.
Ed Nagy and "THE EVICTORS" who run an eviction mill for landlords wanting to double their rents is the acting attorney for Bruce Millar.
Ms. Stancil cannot survive market rents if the eviction is successful, and for this reason alone the community has joined her in an effort to block this eviction. A mother of 1, and grandmother of 2, Ms Stancil was the Executive Secretary of the E. Bay-Rainbow Push Coalition and an Executive Board Member of SEIU 616.
Local activists are urging the community to call landlord Bruce Millar at 925/855-0419 to urge him to stop this unlawful economic eviction now.

I am concerned about this tenant. Unfortunately, this story leaves out enough so that I can't figure out how to do so. I am a landlord and I support tenants getting treated just as fairly as landlords, if not more so. If I can help resolve this problem, please contact me at my email address.
In the past, I have found that similar stories leave out important facts that have a material impact. If, for example, this landlord is raising the rent illegally, there are many provisions available to help the tenant and prevent the eviction. If, on the other hand, the building is being rehabbed in order to improve its earthquake safety or to eliminate vermin or other environmental hazards, the landlord is justified in seeking to get funds for this from the tenants over an extended period of time. If, in fact, the rent increase is illegal, please contact me and I will try to help to resolve the problem.
