OAKLAND, CA — The jury’s request for a copy of the 1st and 4th amendments
of the US Constitution was opposed by the Department of Justice council
Joseph Sher and City of Oakland council Marie Bee. Judge Wilken overruled
the motion to oppose and read those amendments to the jury, but did not
give the jury an actual copy of those amendments for them to return to the
deliberation room. “Their agents obviously haven’t read the Constitution,
so why would they want anyone else looking at it?” said Darryl Cherney, co-
plaintiff in the Civil Rights lawsuit.

Bari v. FBI is in its second day of jury deliberations following a six week
trial. There are four defendant agents from the FBI and three defendant
Oakland Police officers. Lawyers from all sides must be on call to appear
at the courtroom for the remainder of deliberations to answer any questions
the jury may pose

This Friday, May 24, at 12 noon there will be a rally at the Oakland
Federal Courthouse to celebrate Judi Bari Day. Darryl Cherney, Bari’s co-
plaintiff, has proposed to Council member Nancy Nadel of the Oakland City
Council that May 24 be declared Judi Bari Day by the city. The day would
be devoted to education about the life of environmentalist, labor organizer
and feminist Judi Bari as well as FBI persecution of activists, such as the
Black Panthers. Nadel agreed that if Bari and Cherney win the case she
would present it to the City Council for serious consideration.

Un-fucking-believable!

Your argument seems to imply that the COINTELPRO tactics of the FBI are somehow not of "major social significance." The investigation of who committed the bombing obviously is. But shouldn't it be equally obvious that the deliberate refusal of the FBI to do so, when they are the very ones legally entrusted with that responsibiity, and their sinister campaign of defamation, is the first question to address? How can we even arrive at the first without passing initially by the second? Furthermore, how can you be unmoved by the gallant persistence of Bari and Cherny, fighting continuously for over a decade in the face of the full unbridled power and arrogance of America's own Staatspolizei?

What would you have had Bari and Cherny do? Don trenchcoats and grab magnifying glasses to become their own gumshoes, and leave the FBI to its devices In spite of the overwhelming evidence of its duplicity?

There are many people, practically the whole political-economic establishment of the Pacific Northwest, who had a motive to assassinate Bari and Cherny. I agree that the impunity they have enjoyed thanks to the FBI's failure to investigate the attacks is horrible, probably the most horrible aspect of the case. But as I see it, that is ALL THE MORE REASON to make the case AGAINST THE FBI, and NOT pursue a Sherlock Holmes private detective act of trying to find the perps independently. The fact that some private individuals have motives to commit political violence to protect their economic interests is in fact far less ominous than the fact that the government is run by people who deliberately aid and encourage such private violence with a wink and a nod by their actions.

Craig, Rather than calling May 24th "Find the Bomber Day" let's be more accurate and name it more correctly (at least in the case of Judi Bari) as Domestic Violence Day!
